Protection of the child
Subject to the powers of the civil court, the ARP intervenes in the adoption of protective measures, but also in the area of certain aspects related to filiation:
- oversees the establishment of paternal filiation in the case of children born out of wedlock
- decrees the consent of adoption following the period of pre-adoptive foster care on the recommendation of the competent protection office
- approves contracts concerning the maintenance obligation
- collects the declaration concerning joint parental authority issued by the parents following the recognition of the child
- intervenes in the regulation of the child's exercise of personal relations with the parent or third parties
- intervenes on behalf of the child in case of conflict of interest with the legal representative
- in case of divorced parents, approves a new regulation of parental authority, custody and maintenance contribution in case of their agreement
- makes certain verifications in case of the death of one of the parents
- appoints a guardian to the minor child who is not under parental authority
- establishes and deals with the execution of protective measures in favor of the child (appropriate measures, guardianship, extra-familial placement, deprivation of parental authority)
Protection of the adult
The ARP intervenes in the validation of measures ordered in advance by the person who has become incapacitated, in legal representation, and, of course, in the establishment and enforcement of protective measures:
- verifies the existence and validity of a precautionary mandate in the event that a person becomes incapable of discernment
- intervenes when the patient's directives are not respected or the patient's interests are not safeguarded
- establishes and supervises adult protective measures (support curatorship, representative curatorship with or without asset management, cooperative curatorship, and general curatorship)
- orders hospitalizations for the purpose of treatment or care
